DMCA & Copyright Policy

1. Our position on copyright

Promtify is a multi-vendor marketplace for AI prompts. Sellers upload their own prompt text, sample outputs, screenshots and cover images. We take intellectual-property rights seriously and respect the principles of the United States Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, as well as equivalent copyright frameworks in other jurisdictions. If you believe content on Promtify infringes a copyright you own or control, this page explains how to report it and what we will do about it.

2. Who can file a notice

A DMCA notice may be filed by the copyright owner or by a person authorised to act on the owner's behalf (for example, a lawyer, an agency or a brand-protection vendor). Submitting a notice on behalf of someone else without authority is itself a violation of law, and we may forward bad-faith notices to the affected seller along with full contact details of the sender.

3. How to submit a takedown notice

Send your notice to our copyright agent by email at dmca@promtify.app. To be valid under the DMCA, your notice MUST include all of the following:

  1. A physical or electronic signature of the copyright owner or authorised agent.
  2. A clear identification of the copyrighted work you claim has been infringed (for example, the original prompt, image, text, course or registration number).
  3. The exact URL(s) on promtify.app of the listing, image, prompt or page you want removed. "Anything by user X" is not specific enough.
  4. Your full name, postal address, telephone number and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorised to act on behalf of the owner of the exclusive right that is allegedly infringed.

Notices missing any of the above will be returned for correction and will not start the response clock.

4. Response time

Our standard response window for a complete and valid notice is within 48 hours of receipt. In practice we usually act faster. During public holidays or in cases that require additional verification (for example, conflicting ownership claims or notices involving multiple sellers) the response may extend up to 72 hours. When we take action we will:

  • Disable access to the reported listing, image or prompt.
  • Notify the seller of the takedown and forward a copy of your notice (with your contact details, as required by law) so they may file a counter-notice if appropriate.
  • Place any pending payouts tied to the reported content on hold pending resolution.

5. Counter-notices

If a seller believes their content was removed by mistake or misidentification, they may submit a written counter-notice to dmca@promtify.app. A valid counter-notice must include:

  1. The seller's physical or electronic signature.
  2. Identification of the removed material and the URL where it appeared before removal.
  3. A statement under penalty of perjury that the seller has a good-faith belief the material was removed as a result of mistake or misidentification.
  4. The seller's full name, postal address and telephone number, and a statement consenting to the jurisdiction of the appropriate court.

On receipt of a valid counter-notice we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action seeking to restrain the seller, we may restore the removed material.

6. Repeat-infringer policy

Sellers who receive multiple valid takedown notices will have their accounts reviewed. We reserve the right to suspend or permanently terminate the accounts of users that we determine, in our sole discretion, to be repeat infringers. Pending payouts for infringing orders may be reversed.

7. Misuse of the DMCA process

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that content is infringing — or that it was removed by mistake — may be liable for damages, including costs and lawyers' fees. Do not use this process to silence competitors, suppress reviews, or remove content you simply dislike.

8. Trademarks, privacy and other complaints

For trademark complaints, impersonation, doxxing, or other non-copyright issues, please email support@promtify.app with a clear description of the issue and the URLs involved. We handle these complaints separately from DMCA but with the same 48-hour target response window.

Notices sent through other channels (chat, social media, support tickets for unrelated issues) may be delayed. We do not currently accept postal-mail notices; email is the only supported channel.

10. Changes to this policy

We may update this DMCA & Copyright Policy from time to time to reflect changes in law or in our internal processes. The current version is always available at promtify.app/dmca.
